Privacy Policy

RETR LLC (“RETR") is committed to maintaining robust privacy protections for its users. This privacy policy is designed to help you understand how RETR collects, uses, and safeguards the information, including personal information, obtained when you use or access Real Estate Track Record (“RETR.APP”), RETR.APP’s website, or a Track Record (“RETR Platform”). The privacy policy also explains the degree of control you can exercise in the maintenance and sharing of your information.

RETR collects non-personal information and personal information. Non-personal information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information, and referring and exiting pages, and URLs. Personal information includes information that can be used to personally identify you, such as your name, email address, home address, and personal telephone number.

By using or accessing the RETR Platform, you acknowledge and agree that you have read, understand, and agree to be bound by the privacy policy and terms of service. You accept the privacy policy by using or accessing the RETR Platform or by agreeing to a supplemental agreement that expressly incorporates the privacy policy into the agreement.

1. Information RETR Collects.

1.1. Information You Provide. This is the information you provide so you can use and access the RETR Platform. Examples include:

          Account Information. Certain information may be required when you register for an account, such as your first and last name, email address, business address, phone number, and professional credentials. You will also need to provide a username and password for your account.

          Payment Information. Certain services require a paid subscription. In order to process your subscription order, you must provide us an acceptable form of payment.

          Business Contacts and Clients. You may choose to import the contact information of your business contacts and clients to take advantage of certain services.

          Communications. Communications between you and RETR and communications between you and a third party using RETR.APP.

1.2. Use Information. This is the information that RETR may collect when you use or access the RETR Platform. Examples, include:

          Personal Use Information. This is information about how you interact with the RETR Platform.

          Log Data and Device Information. This includes information such as IP addresses, access dates and times, hardware and software information, device information, unique identifiers, and cookie data.

          Cookies. Cookies are small text files which include an anonymous unique identifier. Cookies are sent to your browser from RETR’s servers and are stored on your computer’s hard drive. Sending a cookie to your browser enables us to collect non-personal information about you and keeps a record of your preferences when using the RETR Platform, both on an individual and aggregate basis. For example, RETR may use cookies to: understand, simplify, and improve the user experience; monitor and analyze the performance of RETR’s services; or deliver targeted content and advertisements to you. RETR may use both persistent and session cookies. Persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

          Location. This information allows us to know the general location of users so RETR can provide the best services possible.

2. How RETR Uses Information.

2.1. Personal Information. In general, your Personal Information is used to help RETR communicate with you and provide you the best experience possible. Examples include:

          Communications between you and RETR.

          Improve customer service.

          The creation and maintenance of your account.

          Verify your professional credentials, such as your NMLS unique identifier.

          Enable you to communicate with third parties using RETR.APP.

          To implement RETR.APP’s auto-nurture feature.

          Operate, protect, improve, and optimize the RETR Platform. 

          Comply with legal obligations.

          Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.

          Ensure compliance with RETR.APP’s terms of service and privacy policy.

Except as otherwise stated in the privacy policy or terms of service, RETR does not sell, trade, rent or otherwise share personal information with third parties for marketing purposes without your consent. RETR may share personal information with vendors who are performing services for us, such as the servers for RETR’s email communications. These vendors use your personal information only at RETR’s direction and in accordance with RETR’s privacy policy.

2.2. Non-Personal Information. In general, RETR uses non-personal information to help customize and improve the experience for RETR’s users. RETR also aggregates non-personal information in order to track trends and analyze use patterns. This privacy policy does not limit in any way RETR’s use or disclosure of non-personal information, and RETR reserves the right to use and disclose such non-personal information to RETR’s partners, advertisers and other third parties at RETR’s discretion.

3. How RETR Shares Information.

RETR only shares your personal information when needed for a legitimate business or legal purpose. Examples include:

          Professional Information. Your publicly available professional information, such as your brokerage affiliations, NMLS unique identifier, business address, and business phone number may be displayed.

          By Request. RETR allow subscribers to share Track Records and communicate with third parties. RETR also communicates with third parties on your behalf through the auto-nurture feature. RETR will share the information needed to comply with those requests. 

          Certain Business Transactions. In the event RETR undergoes a business transaction such as a merger, acquisition by another company, or sale of all or a portion of RETR’s assets, your information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this privacy policy, and that any acquirer of RETR’s assets may continue to process your personal and non-personal information as set forth in this privacy policy.  

          Legal Compliance. RETR will share your personal and non-personal information to comply with any lawful request or legal obligation.

4. Control of Your Information.

Consistent with applicable law, you may exercise any of the rights described in this section. In some cases, you may have to contact us to exercise your right. Please contact us at hi@retr.app. RETR may ask for you to verify your identity before responding to your request

          Update your account information in the account settings.

          Correct personal information on RETR.APP that is inaccurate.  

          You can remove cookies and browser web storage data by following your web browsers instructions. However, please know that if you disable cookies, the RETR Platform may not work properly.

5. How RETR Protect Information.

RETR implements security measures designed to protect your information from unauthorized access. Your account is protected by your account password and RETR urges you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. RETR further protects your information from potential security breaches by implementing certain technological security measures, such as encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using the RETR Platform, you understand and agree to assume these risks.

6. Communications from RETR LLC.

You have the right at any time to prevent us from contacting you for marketing purposes. When RETR sends a promotional communication to you, you can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional email. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in your account settings, RETR may continue to send you administrative emails, for example, updates about RETR’s privacy policy and terms of service.

7. Links to Other Websites.

As part of the RETR Platform, RETR may provide links to other websites or applications. The RETR Platform’s use of links is not meant as an endorsement or proof of affiliation with the linked websites or applications. RETR is not responsible for the privacy practices employed by those websites or the information or content they contain. This privacy policy applies solely to information collected by RETR. Therefore, this privacy policy does not apply to your use of a third-party website accessed by selecting a link on the RETR Platform. The privacy policy of the third-party website or application will apply to your access or use of that site or application. RETR encourages you to read the privacy policies and terms of use of other websites before using them.

8. Modification to RETR’s Privacy Policy.

RETR reserves the right to modify the privacy policy at any time at RETR’s sole discretion. If RETR modifies the privacy policy, you will be notified in accordance with the terms of service.
